New US witness is Tracy Chapell of FedEx. AUSA: What is this? Chapell: It's from Jeffrey Epstein's FedEx account. AUSA: We want it sealed. Judge Nathan: Granted. Chapell: It's an invoice. AUSA: Under seal. Judge Nathan: Yes.
The sealed invoices are from 2002; the redacted version, on the screens, are illegible. Now cross examination. Maxwell's lawyer: Look at [sealed] Exhibit 806.
Maxwell's lawyer: So this package was to Carolyn. But it was not from Ghislaine Maxwell, correct? Chapell: It is not. Maxwell's lawyer: There is no other transaction on this invoice where Ghislaine Maxwell is sending a package to someone named Carolyn, correct?
Now Maxwell's lawyer is putting forward an exhibit under "temporary seal." Temporary until when? Inner City Press is putting together a letter - watch this feed. Maxwell's lawyer: I have no further questions for this witness.
Assistant US Attorney: We need an session with your Honor in the robing room. Judge Nathan: An extended sidebar? AUSA: It would need to be in the robing room. [Inner City Press finalizing letter]
Judge Nathan re-takes the bench. No summary given of what the robing room discussion was about. Judge Nathan: Please bring in the jury. [Letter fast-finished and filed - watch this feed]
Judge Nathan: There is an attorney in the case who is ill and needs treatment. It is not COVID related but we are going to break for the day.
#Breaking: The US v. #GhislaineMaxwell trial as been cancelled, at least for today. Judge says an attorney in case is ill & needs treatment. Says it is not COVID-related. Inner City Press just filed a 3d letter for call-in citing Omicron:
With US v. #GhislaineMaxwell trial suspended due to ill prosecutor but still no public call-in line, right now Inner City Press is covering an SDNY criminal proceeding by phone, & will tweet some below this morning's filing to Judge Nathan
Kramer Case side note
OK - now in District of DC federal court, Jan 6 defendant Philip Edward KRAMER before Judge Emmet G. Sullivan - with a public call-in line such is being denied in US v. #GhislaineMaxwell. Inner City Press has re-requested one and will live tweet, thread below
Judge Sullivan: I have to advise you that the Court could detain you if I accept your plea of guilty. Do you understand? Kramer: I do.
Sullivan accepts Kramer's guilty plea to Count 4. Sentencing will be on April 7 at 1 pm - also with a call-in line, Judge Sullivan says. Here was DOJ's "Statement of facts"
Right now in a @SDNYLIVE criminal case with a call-in line, Judge Jed S. Rakoff said he doesn't believe the prosecutors their case would take 4 weeks, saying that in "a little case called Maxwell" they'd said 4-5 weeks but are resting this week. Now, will then?
side note
Note: I could/should have added that Judge Rakoff said "a little case called Maxwell" sarcastically, or really, facetiously. I think his point was that the prosecutors had so badly overestimated their time in the high-profile Maxwell case that he was now dubious
Replying to @innercitypress @sdnylive and 2 others A LITTLE CASE ?!?!
Spacey, defending himself from claim he raped Rapp, wanted get discovery into all of his past relationships. Spacey's lawyer: He's only alleging that Mr Fowler [that is, Kevin Spacey] picked him up and dropped him. It's essentially child abuse, not sexual assault.
Rapp's lawyer: I am haunted at not convincing the court to allow C.D. to go anonymous, as is being allowed in a major criminal case now in our court, of Ghislaine Maxwell. But here, C.D. dropped out.
Rapp's lawyer: Evan Lowenstein's wife has gotten an order of protection against Mr Spacey being with her children, as I understand it. Judge: And this summation is relevant how?
Judge: What if we limit you to examining incidents where the identity of the other person has become public and the person was under 18? Rapp's lawyer: Even if a person was over 18, throwing them on the bed and jumping on top of them is relevant
Rapp's lawyer: I don't intend to ask Mr. Spacey, at deposition, Tell me every person you've had sex with. Judge: You've called my approach perverse. Frankly, it's not welcome. Rapp's lawyer: I was not calling you perverse.
Yes - in this lawsuit against him, the defendant insists on being referred to as "Kevin Spacey Fowler," make it officials Rapp v. Fowler and keeping it, for some, under the radar. But it's Kevin Spacey.
Replying to @innercitypress
…“Fowler?”
